A.Nos.2962 & 2963 of 2022 in C.S.(Comm. Div) No.37 of 2021 SENTHILKUMAR RAMAMOORTHY,J These applications are presented by the plaintiff to re-open the examination -in-chief of PW1 and for permission to exhibit the Board Resolution as an additional document.
2. Learned counsel for the applicant states that the Board Resolution by which PW1 was authorized to institute the suit was inadvertently not filed at the time of institution of the suit and that the present applications are filed to exhibit the same.
3. The respondent has no objection to these applications being allowed subject to the right of the respondents to file an affidavit of admission/denial in respect thereof and raise objections inter alia on grounds of admissibility, relevance and proof. 4.Upon examining the affidavit filed in support of these applications and being satisfied that reasonable cause is shown, these applications are allowed subject to the right of the respondents / defendants to file an affidavit of Page No.1/2 https://www.mhc.tn.gov.in/judis

Consequently, list the matter before the learned Additional Master III on 02.08.2022 for the examination of PW1. Such examination shall be concluded on or before 05.08.2022. List before this Court on 10.08.2022 for fixing the schedule for recording the defendant's evidence.
