The lender / financial institution has presented this application seeking to raise the prohibitory order dated 12.03.2018 in A.No.5189 of 2016.
2. The applicant had extended credit facilities to respondents 1 and 2. Upon default, A.No.5189 of 2016 was filed and an order dated 12.03.2018 was issued attaching the salary of the second respondent. In paragraph 4 of the affidavit, the applicant states that an amicable settlement was arrived at between the lender and borrower. The present application is filed in the said facts and circumstances.
3. An order raising the attachment would enure to the benefit of the respondents. The said application is presented by the lender at whose instance the said order was issued. Consequently, notice to the respondents is not necessary.
