VELMURUGAN CRIMINAL MISCELLANEOUS PETITION No.75 of 2018 IN CRL A.8/2018 R.KUMAR, [ PETITIONER/APPELLANT] Vs THE STATE REP BY ITS, [ RESPONDENT ] THE INSPECTOR OF POLICE, ALL WOMEN POLICE STATION, RANIPET, VELLORE DISTRICT.

Petition praying that in the circumstances stated therein and in the Memorandum of Grounds in Criminal APPEAL No.8 OF 2018 on the file of the High Court, the High Court will be pleased to suspend the sentence made in S.S.C.No.18 of 2016 dated 22.11.2017 on the file of the Sessions Judge, Mahalir Neethi Mandram (Fast Track Mahila), Vellore, to undergo Rigorous Imprisonment for two years and to pay a fine of Rs.5,000/- (Rupees Five Thousand only) in default to undergo one month Simple Imprisonment for U/S 450 of IPC and to suspend the sentence to undergo Rigorous Imprisonment for three years and to pay a fine of Rs.5,000/- (Rupees Five Thousand only) in default to undergo one month Simple Imprisonment for u/s.354-B of IPC and to suspend the sentence to undergo Rigorous Imprisonment for ten Years and to pay a fine of Rs.5,000/- (Rupees Five thousand only) in default to undergo one month simple Imprisonment pending disposal of above appeal.

Order : This petition coming on for orders upon perusing the petition and the Memorandum of Grounds in Crl.A.No.8 of 2018 on the file of the High Court and upon hearing the arguments of MR.K.CHANDRU, FOR M/S.DASS AND VISWA ASSOCIATES, Advocate for the petitioner and of MR. R.RAVICHANDRAN, Govt. Advocate ( Crl. Side) on behalf of the Respondent the court made the following order:- This Miscellaneous Petition has been filed seeking to suspend the sentence in S.S.C.No.18 of 2016 dated 22.11.2017 on the file of the learned Sessions Judge, Mahalir Neethimandram (Fast Track Mahila) Vellore.

2. Heard both sides.

3. This miscellaneous petition is pending from 2018. Since the

petitioner is in Judicial Custody, this Court is not inclined to suspend the sentence.

4. In view of the above, this Miscellaneous Petition is dismissed.
