ORDER : The Court Made the following order :- (The case has been heard through video conference) The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 8(c), 20(b)(ii)(B) of Narcotic Drugs and Psychotropic Substances Act, 1985, in Crime No.1006 of 2021, on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that A2 was found in illegal possession of 1 Kg and 150 Grams of Ganja. Based on the confession of A2, the petitioner has been implicated in this case. 3.The learned counsel appearing for the petitioner submits that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail to the petitioner. 4.The learned Government Advocate (Crl.Side) submits that A2 was found in illegal possession of 1 Kg and 150 Grams of Ganja. Based on the confession of A2, the petitioner was implicated in this case. He further submits that there are ten previous cases pending as against the petitioner. He further submits that this Court vide Order dated 08.07.2021 in Crl.OP.No.11687 of 2021 dismissed the petitioner's earlier petition and there is no change of circumstances after the https://hcservices.ecourts.gov.in/hcservices/
dismissal of the petitioner's earlier petition. Hence, he vehemently opposed for grant of anticipatory bail to the petitioner.
5. In view of the submissions made by the learned Government Advocate (Crl.Side) and also considering the fact that there are ten previous previous cases against the petitioner and there is no change of circumstances after the dismissal of the petitioner's earlier petition, this Court is not inclined to grant anticipatory bail to the petitioner.
