Respondents Writ petition filed under Article 226 of the Constitution of India praying for a writ of mandamus to direct the respondent to consider the representation of the petitioner dated 30.01.2015 to grant patta for her residence at No.4, Taluk Office Road, No.59, Ponneri Village, comprised in S.No.508/8A to an extent of 2.5 cents.

ORDER

Heard Mr.R.Arun, learned counsel for the petitioner and Mr.R.Vijayakumar, learned Additional Government Pleader who accepts notice for the respondents and with their consent, the writ petition is disposed of at the admission stage itself. 2.The petitioner seeks for issuance of a writ of mandamus to direct the respondent to consider the representation of the petitioner dated 30.01.2015 to grant patta for her residence at No.4, Taluk Office Road, No.59, Ponneri Village, comprised in S.No.508/8A to an extent of 2.5 cents.

3.Admittedly, the land in question is a Government property and the petitioner claims to be in possession of the property for several years. In support of her claim, the petitioner relies upon the Electricity Bills and certain tax receipts. https://hcservices.ecourts.gov.in/hcservices/

4.Since the land in question is a Government property, no writ of mandamus can be issued to compel the respondents to grant patta. Hence, the relief sought for cannot be granted and on positive direction can be issued. Accordingly, the writ petition fails and the same is dismissed. No costs.

5.However, this will not prevent the petitioner from pursuing her representation before the authorities concerned, which shall be considered in accordance with law.
