Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.K.SUTHAN, Advocate for the Petitioners and of MR. A.GOPINATH, Govt. Advocate ( Crl. Side) on behalf of the Respondent the court made the following order:- This petition is filed to modify the condition imposed on the petitioners by this Court in Crl.O.P.No.15077 of 2021, dated 24.08.2021.
2.This Court vide order dated 24.08.2021, granted anticipatory bail to the petitioners on condition that the petitioners shall pay a sum of Rs.3,50,000/- (Rupees Three Lakh Fifty Thousand Only) to the defacto complainant and also accepted to return the blank papers where it was alleged that the petitioners got the signature of the defacto complainant, without prejudice to his rights and contentions in the case before the learned Judicial Magistrate-I, Poonamallee. https://hcservices.ecourts.gov.in/hcservices/
3. Today, when the matter is taken up for hearing, the learned counsel for the petitioners submitted that the petitioners have already paid Rs.97,000/- to the defacto complainant and now they need to pay the balance amount of Rs.2,53,000/-. He further submits that the petitioners are unable to pay the balance amount. Hence, the present modification petition is filed by the petitioners to modify the conditions imposed on the petitioners.
4. This Court had granted anticipatory bail only on the petitioner, on his own volition accepting to pay the above amount. Therefore, the petitioner cannot come before this Court and seek modification of the above condition, which is impermissible. Hence, this petition for modification is dismissed. Hence, time granted for two weeks to comply with the order.
