[RESPONDENTS] PRAYER : Petition filed Under Article 226 of the Constitution of India praying to issue Writ of Mandamus to direct the second respondent to issue a corrected TDS certificate under Form 16-A certificate for deduction under section 203 of the Income Tax Act 1961 by altering the PAN NO. from AABPN2834L to AAAHS 2110 K in the name of the petitioner J. Navarathanmal Jamad in a time bound period.

Heard Mr.K.Mohanamurali, learned Counsel appearing for the petitioners and Mr.R.Vijayakumar, learned Additional Government Pleader who accepts notice for the respondents and with their consent the Writ Petition is taken up for final disposal. 2.The petitioners seek for a direction to the second respondent to issue corrected TDS certificate under Form 16-A, by altering the Pan Number mentioned in the certificate. https://hcservices.ecourts.gov.in/hcservices/

3.The petitioner submits that the Pan Number given in the TDS certificate is wrong and the petitioner's correct Pan Number has to be entered and amended certificate has to be issued. In this regard, the petitioner has sent a representation through his Advocate to the second respondent on 02.07.2015. 4.It is not in dispute that earlier the petitioner has filed a writ petition before this Court in W.P.No.14255 of 2013, wherein the petitioner has challenged the order passed by the second respondent dated 6.5.2013. In the said writ petition, the petitioner's brother S.Mahaveerchand Jamad, has been impleaded as third respondent. However, in the present case, he has not been impleaded as the respondent.

5.The explanation given by the learned counsel for the petitioner is that the present claim made by the petitioner for correcting the Pan Number has nothing to do with the claim made by this brother and his brother has already received his share of compensation.

6.In the light of the above, without going into the merits of the petitioner's claim, a direction is issued to the second respondent to consider the petitioner's representation sent through his Advocate on 02.07.2015, and after notice to all concerned, appropriate orders shall be passed on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.
