A.No.3003 of 2024 in C.S. No.198 of 2023 C.V.KARTHIKEYAN, J This application has been filed seeking to condone the delay of 189 days in filing the written statement of the 5th defendant.

In the affidavit filed in support of the Judge's Summons, it had been stated that since the Officer who dealt with the legal issues was transferred, the other Officer, owing to over sight, had failed to instruct the counsels for filing the written statement. In the process, there has been a delay which has arisen.

Heard the learned counsel for the plaintiffs also.

Taking all the factors into consideration, this application stands allowed and the written statement of the 5th defendant to be taken on record.

Registry may list the suit under the same caption 'Undefended Board'

on 16.07.2024, since D4, D6 and D7 have not filed their written statement.
