This petition has been filed to permit the petitioner/defacto complainant herein to withdraw the amount deposited on 17.02.2023 vide Bill No.04160, a sum of Rs.2,00,000/- before the XIV Metropolitan Magistrate, Egmore, Chennai as per the order of this court in Crl.O.P. No.3306 of 2023 dated 16.02.2023.

Mr.I.Gowrishankar, learned counsel for petitioner would submit that as per the order of this court in the above petition directing the petitioner A.K.Shakir Hussain to deposit a sum of Rs.2,00,000/- into the credit of Crime No.14 of 2023 before the concerned Magistrate and the same was deposited by him on 17.02.2023 vide Bill/receipt No.04160. He would also submit that the parents of victim girl were permitted to withdraw the said amount in all the above similar petitions filed by the accused. Hence, he filed the present petition seeking to permit the petitioner/defacto complainant to withdraw the deposited amount. 1/3

Considering his submissions, this Court is inclined to allow this petition permitting the petitioner to withdraw the amount of Rs.2,00,000/- (Rupees two lakhs only) by submitting an undertaking affidavit before the trial court, where the amount is deposited. Accordingly, this Criminal Miscellaneous Petition is ordered. 03.08.2023 rpp 2/3
