Defendants PRAYER : This Civil Suit filed under Order XXXVII Rules 1 & 2 of CPC read with Order IV Rule 1 of Original side Rules, praying for the following reliefs: a) Directing the Defendants to jointly and severally to pay to the Plaintiff the sum of Rs.58,25,000/- (Rupees Fifty Eight Lakhs and Twenty Five Thousand only) together with the Interest at the rate of 18% per annum on Rs.50,00,000/- (Rupees Fifty Lakhs Only) from date of Plaint till the date of payment; and b) To award the costs of the suit.

JUDGMENT

The learned counsel for the plaintiff has made the following endorsement in the plaint:- "may be permitted to withdraw the suit as matter has been settled out of Court. Henc e, may be dismis s e d as withdrawn." 2 .

In view of the endorsement made, the suit is dismissed as withdrawn as settled out of Court.

Since the suit had been settled, the plaintiff is entitled to refund of Court fees as per rules.

The learned Counsel for the plaintiff made a request that the Document No.2, which is settlement deed, may be returned back to him. The said document will be returned on providing copy of the same under proper acknowledgment.
