The petitioner apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 6(4) of TNSC (RDCS) Order 1982 read with Sections 7(i) a (ii) of E.C Act, in Crime No.95 of 2022, seeks anticipatory bail.

2. The case of the prosecution is that on 27.05.2022 at about 05.00.p.m., when the respondent police were on their regular patrol duty, they found that the lorry bearing registration No. TN 60 C 6267 mini van transporting 12,000 kgs of PDS rice worth about Rs.67,800/- without obtaining permission from the concerned authority. Hence the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and no way connected with the alleged offence. Hence he prays to grant anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor submits that co-accused in this case has been arrested and released on bail. However, he opposed to grant anticipatory bail to the petitioner.

5. Considering the gravity of the offence committed by the petitioner and also considering the quantity of PDS rice involved in this case, this Court is of the view that the custodial interrogation of the petitioner is essential. Hence, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed. 20.07.2022 Sma
