The petitioner, who apprehends arrest at the hands of the respondents police for alleged offences punishable under Sections 417 and 376 IPC in Crime No.9 of 2022 on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that the petitioner and the defacto complainant were for certain period and it is alleged that the petitioner promised her to have get married her and received certain amount from the defacto complainant and cheated her.
3. The learned counsel for the petitioner submitted that the petitioner is an innocent and he has been falsely implicated in this case. Therefore, he prays for anticipatory bail to the petitioner.
4. The learned Additional Public Prosecutor submitted that the petitioner promised the defacto complainant to marry her and received some amount and cheated her. Therefore, he vehemently opposed to grant anticipatory bail to the petitioner.
5. On a perusal of the FIR it revealed that the petitioner fell in love with the victim girl and promised her to get marriage, had physical relationship with the victim. On the pretext of marriage, the defacto complainant also transferred a sum of Rs.5 lakhs in favour of the petitioner herein. Thereafter, the petitioner refused to get marry the defacto complainant and also got married with the another person. Further, the defacto complainant also present before this Court and deposed the same. Therefore, custodial interrogation of the petitioner is very much required in this case. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.
