M/S.Cholamandalam Investment And Finance Co., Ltd., v. Mr.Manik Nanasaheb Kachole And Another

Application No.3413 of 2019 in C.S.No.371 of 1985 PUSHPA SATHYANARAYANA, J.

The suit filed by the applicants in C.S.No.371 of 1985 was decreed on 15.11.1988 for a sum of Rs.1,20,000/-. The Tamil Nadu Electricity Board, who is the defendant in the suit, had deposited a sum of Rs.40,263/- to the credit of the said suit and the same was lying with the Registry. The applicant has also produced the Funds Availability Certificate dated 31.08.2017 issued by the Joint Registrar (Oiginal Side), High Court, Madras. Seeking to order payment out of the sum of Rs.40,263/- to the applicants, this application has been filed.

2. There are four plaintiffs, of which, plaintiffs 2 to 4 were minors represented by their mother and natural guardian Tara Masthan at the time of filing the suit. Today all of them have become major and they filed independent affidavits stating no objection for the first plaintiff Tara Masthan to receive the amount. The said affidavits are also taken on record.

3. The learned counsel appearing for the respondent also has got no objection for ordering payment out of the same for a sum of Rs.40,263/- to the applicants. Accordingly, the application is ordered. http://www.judis.nic.in

4. The Registry is directed to pay the amount, which is kept in deposit to the credit of C.S.No.371 of 1985 to the first applicant herein forthwith.
