ANAND VENKATESH CRIMINAL MISCELLANEOUS PETITION No.8286 of 2019 IN CRL.OP.NO.8286 OF 2019 SALAUDEEN ABDUL RAZHAK [PETITIOENR] Vs THE INSPECTOR OF POLICE, [RESPONDENT] AALL WOMEN POLICE STATION, PANRUTI, CUDDALORE DISTRICT CRIME NO.6 OF 2018.
Petition praying that in the circumstances stated therein the High Court will be pleased to direct the respondents to withdraw the LOC issued against the petitioner and pass such further or other orders.
Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of MR.V.V.SAIRAM Advocate Advocate for the petitioner and of MR.C.RAGHAVAN Government Advocate on behalf of the Respondent the court made the following order:- While considering the anticipatory bail petition filed by the petitioner, taking into consideration the stand taken by the respondent police that 41-A notice is issued to the accused persons to conduct an enquiry, the same was recorded and the petition was disposed of.
2. The petitioner was directed to appear before the respondent on 26.06.2019 for the enquiry.
3. It is now brought to the notice of this Court that there is a Look Out Circular pending against the petitioner and that the petitioner will not be able to attend for the enquiry on 26.06.2019 unless the LOC is withdrawn, failing which the petitioner will be detained by the Immigration Department.
4. There shall be a direction to the respondent police to immediately inform the Immigration Department about the orders passed by this Court directing the petitioner to appear before the respondent on 26.06.2019 and consequently withdraw the Look Out Circular. If the petitioner is detained pursuant to the Look Out Circular, the direction given by this Court to the petitioner cannot be complied with. In view of the shortage of time, the petitioner is
directed to appear before the respondent police for enquiry on 04.07.2019 at 11.00 a.m.
5. This Criminal Miscellaneous Petition is disposed of with the above direction.
