C.M.P.No.14769 of 2024 in A.S.No.487 of 2024 R.SUBRAMANIAN, J.

and C.KUMARAPPAN, J.

The petitioner seeks stay of operation of the decree in O.S.No.1080 of 2021.

2. The said decree declares that the registered settlement deed dated 27.08.2015 is null and void and not binding on the plaintiff. Consequential injunction has also been granted restraining the defendants from alienating or encumbering the suit property as well as interfering with the peaceful enjoyment of the property by the plaintiff.

3. A perusal of the decree shows that there is no executable decree. Hence, the stay petition is mis-conceived. Leaving it open to the petitioner to file appropriate petition, this stay petition stands dismissed. (R.S.M., J.) (C.K., J.) 05.11.2024 dsa https://www.mhc.tn.gov.in/judis 1/2
