O R D E R

When this Contempt Petition is taken up for hearing today, the Member Secretary of Cuddalore Local Planning Authority has filed an affidavit stating the reasons for the delay in complying with the order of this Court in Writ Petition. Even though the same is not very satisfactory, I do not think that action should be initiated against him despite the fact remains that our magnanimity is often misunderstood as gullibility on the Government side. It is stated that the application of the petitioner seeking regularization has again been rejected on the ground that the petitioner has not produced 'No Objection Certificate', however, handedover the document. It is also stated that if the petitioner applies with appropriate fresh application together with required documents, the same will be considered on merits and necessary orders would be passed. 2.

In the light of the above, this Contempt Petition is closed with a direction to the Officer concerned, viz. the Member Secretary of Cuddalore Local Planning Authority, the respondent herein, to consider and dispose of the application, if any, filed by the petitioner afresh within 2/4

a period of two months from the date on which it is received by the respondent, by passing orders on merits. However, there shall be no order as to costs.
