Respondents Prayer: Petition filed under Article 226 of The Constitution of India praying to issue a writ of mandamus directing the respondents to consider the petitioner's representation dated 27.- 08.2015 and as per the reference by the second respondent dated 9.9.2015 with regard to the said properties in Thiruvallur District, Ponneri Taluk, Anuppampatu Post, Kandhanpalayam village, Number 98 in Nalur village-II, measuring an extent of 0.67.0 Ares in dry Survey No.303/6A2, 0.39.00 Ares in dry Survey No.303/6B, 0.05.5 Ares in dry Survey No.311/2B, 0.15.0 Ares in dry Survey No.311/3B2, 0.08.0 Ares in dry Survey No.311/3C1 and 0.09 cents in Grama Natham Survey No.317/1 to include in the patta along the petitioner's mother's name Mrs.Anusuyammal the petitioner's name and his brother's name Babu jointly.

ORDER

Alleging that the petitioner and his family have been in possession and enjoyment of the specific extent of the properties, a representation was made by the petitioner on 27.8.2015 seeking issuance of patta. On receipt of the said representation on 31.8.2015, the Revenue Divisional Officer, Ponneri viz., the 2nd respondent in Na.Ka.55/240/2015/A1 dated 7.9.2015 has directed the 3rd respondent to take appropriate action and file the report. As no further action is forthcoming, the present writ petition has been filed before this Court by the petitioner.

2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate appearing for the respondents.

3. Considering the above facts, without going into the merits of the same, the 3rd respondent is directed to send a report after due enquiry to the 2nd respondent in pursuant to the communication dated 7.9.2015 within a period of six weeks from the date of receipt of a copy of this order. Thereafter, appropriate orders shall be passed by the 2nd respondent within a further period of six weeks after due notice to the parties concerned. The writ petition stands disposed of accordingly.
