THE HONOURABLE MR.JUSTICE T.RAJA Tr.C.M.P.No.629 of 2019 and C.M.P.No.18118 of 2019 S.Kanakavalli ... Petitioner/Respondent -vsRahul Ravichandran ... Responden/Petitioner Prayer:
Petition filed under Section 24 of C.P.C to withdraw H.M.O.P. No. of 2019 in I.A. No.531 of 2019 in Sr.No.2359 of 2019 from the file of III Additional Family Court, Chennai and transfer the same to Subordinate Judge, Tambaram, Chennai. For Petitioner : Mr.Vinoth Kumar V.C.
O R D E R
The Tr.C.M.P. cannot be entertained for the simple reason that the distance between Sub Court, Tambaram and Additional Family Court, Chennai is not far. Secondly, although the learned counsel appearing for the petitioner attempted to convince this Court stating that the petitioner has suffered some problem in stomach, for which, she also took treatment in April 2019, there is no document showing that the petitioner has been taking continuous treatment. Therefore, finding no substance whatsoever, keeping in mind that the distance from Family Court, Chennai to Sub Court, Tambaram is only 20 kms. and that there are 8 Family Courts functioning in Chennai and it will give fastest disposal, this Court is unable to accept the prayer for transfer from Chennai to Tambaram, hence, the petition is dismissed. Consequently, connected C.M.P. is also dismissed. No costs.
