ORDER
This Writ Petition has been filed for a Mandamus, to direct the first respondent to consider and pass appropriate orders on the petitioner's representation dated 10.07.2014 within a stipulated time.
2. The specific case of the petitioner is that the third respondent/the Panchayat President of Vilandhai Village, Udayarpalayam Taluk, Ariyalur District, has appointed one Palanisamy as a Clerk, who is not an employee of the third respondent but acts as a benami of the third respondent.
3. The further case of the petitioner is that the said Palanisamy insisted the beneficiaries to pay a sum of Rs.2,000/- to Rs.2,500/- on behalf of the third respondent wherever, any payments are to be made to the beneficiaries of the Panchayat.
4. It is submitted that the petitioner has sent a representation to the first and second respondents on 10.07.2014. However, it did not evoke any response from the first and second respondents. The learned counsel for the 2/4
petitioner is however unable to confirm whether anything survives for adjudication in the present writ petition, since fresh elections have been held for the succeeding period and whether the same person has been reelected as Panchayat President or not in the ensuing elections. The status as to whether the said Palanisamy is continuing to occupy the seat of the de facto clerk of the third respondent/Panchayat President is also not known.
5. Considering the same, I am inclined to close this writ petition. However, liberty is given to the petitioner to approach this Court, in case, the same person continues to discharge the function as a de facto clerk of the third respondent/Panchayat President, without any authorization.
6. With the above observations, this Writ Petition stands closed. No costs.
