..Respondent(s) Prayer: This writ petition is filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus forbearing the respondents and their subordinate from interfering with the peaceful possession and enjoyment of the properties comprised in Survey Nos.128/1,128/19 and 129, totally an extent of 8.30 acres situated at Cherumully village, Gudalur Taluk, Nilgiris District based on the representation of the petitioner dated 01.08.2021. ORDER
This writ petition has been filed to direct the respondents to consider the petitioner's representation dated 01.08.2021.
2. The learned counsel for the petitioner would submit that in this case, the petitioner has given a representation dated 01.08.2021 to forbear the respondents and their subordinate from interfering with the peaceful possession and enjoyment of the properties comprised in S.Nos.128/1, 128/19 and 129, totally an extent of 8.30 acres situated at Cherumully Village, Gudalur Taluk, Nilgiris District. However, the said representation was not at all considered by the respondents, as on date. Hence, this petition.
3. In reply, the learned Additional Government Pleader appearing for the respondents would submit that the petitioner's representation dated 01.08.2021 will be disposed of by the respondents within a period of 8 weeks.
4. Heard the learned counsel on either side and perused the materials available on record.
5. In view of the above, without expressing any opinion on the merits of
the case, this Court directs the respondents to dispose of the petitioner's representation dated 01.08.2021, on merits and in accordance with law, within a period of eight (8) weeks from the date of receipt of a copy of this order.
