Respondent PRAYER: Criminal Miscellaneous Petition is filed under Section 482 of Criminal Procedure Code praying to extend time by two weeks to comply with the condition that the petitioner should deposit a sum of Rs.20,00,000/- (Rupees Twenty Lakh only) to the credit of Crime No.25 of 2019 before the learned Judicial Magistrate II, Erode imposed by this Court by way order passed in Crl.M.P.No.3223 of 2020 in Crl.O.P.No.33250 of 2019 on 12.03.2020.

O R D E R

(The case has been heard through video conference) This petition has been filed to extend the time granted to the petitioner in Crl.M.P.No.3223 of 2020 in Crl.O.P.No.33250 of 2019 dated 12.03.2020 to execute sureties and to comply with the conditions.

2.The learned counsel for the petitioner would submit that the petitioner was granted anticipatory bail by this Court in Crl.O.P.No.33250 of 2019 on 18.12.2019 with the condition the petitioner shall deposit a sum of Rs.20,00,000/- to the credit of Crime No.25 of 2019. He would submit that since the petitioner was unable to raise funds earlier filed an application in Crl.M.P.No.3223 of 2020 for extension of time and this Court by order dated 12.03.2020 extended the time by two weeks. However, he would submit that the order copy was made ready on 13.03.2020. Due to the Covid Pandemic situation, the petitioner could not comply with the condition within stipulated period and he would further submit that as on date, the petitioner is ready to deposit a sum of Rs.20,00,000/- before the Court concerned.

3. Heard both sides.

4. Considering the facts and circumstances of the case, this petition is ordered and the petitioner shall surrender and deposit the amount and execute the sureties as ordered by this Court within two weeks from the date of receipt of copy of this order. Failing which, the anticipatory bail granted to the petitioner shall stand automatically cancelled.
