ORDER : The Court Made the following order :- The petitioner who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 406, 420 & 506(i) of IPC in Crime No.407 of 2021 on the file of the respondent police, seek anticipatory bail.

2. The case of the prosecution is that the the petitioner and A1 purchased fishes from the defacto complainant for a sum of Rs.23,14,600/-, for which, he paid Rs.5,00,000/-. The balance amount of Rs.18,14,600/- was not paid. Hence, the complaint.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent persons and he has been falsely implicated in this case. the petitioner is only a lorry driver and he is no way connected in this case and prayed for grant of anticipatory bail.

The learned Government Advocate submitted that after taking goods, the petitioner along with other accused purchased fishes from the defacto complainant for a sum of Rs.23,14,600/-, for which, he paid Rs.5,00,000/-. The balance amount of Rs.18,14,600/- was not paid. Investigation is still pending. Therefore, he opposed to grant anticipatory bail to the petitioner.

5. Taking into consideration the facts and circumstances of the case and also of the fact that the case is in the initial stage of the investigation and that the custodial interrogation of the petitioners is essential, this Court is not inclined to grant anticipatory bail to the petitioners.
