In all CRPs Mr.J.Jyothish Chander COMMON ORDER These civil revision petitions have been filed, aggrieved by the impugned order passed by the executing court, refusing to grant stay of all further proceedings in the execution petitions under Order XXI Rule 26 of CPC, against the awards, which are the subject matter of the execution petitions.
2. The petitioners have filed statutory appeals under Section 70 of the Chit Funds Act. According to the petitioners, the appeals are still pending consideration by the appellate forum. According to the petitioners, the appeals are being taken up yearwise. In view of the same, the petitioners contend that they are not in a position to obtain stay of the awards, which are the subject matter of the execution petitions. Under those circumstances, the learned counsel for the petitioners seek stay for a limited period from this Court of all further proceedings in the execution petitions, which are the subject matter of these civil revision petitions.
3. The learned counsel for the petitioners seek interim stay of all further proceedings in the execution petitions for a limited period of eight weeks.
However, the same is contested by the learned counsel appearing for the respondent/decree holder, who would submit that eight weeks is too long a time and it would suffice if four weeks' time is granted, as was granted in the connected matters by this Court.

After hearing both the submissions, this Court deems it fit to grant six weeks interim stay of all further proceedings in the execution petitions, which are the subject matter of these civil revision petitions, to enable the petitioners to approach the appellate forum and seek stay of all further proceedings in the execution proceedings.
5. Accordingly, these civil revision petitions are disposed of by granting interim stay of all further proceedings in the execution petitions, which are the subject matter of these civil revision petitions, for a further period of six weeks only, and if the petitioners are unable to get stay from the appellate forum, where the petitioners have filed the appeal as against the awards passed by them, the executing court can proceed with the execution petitions thereafter. No Costs. Consequently, connected miscellaneous petitions are closed. 08-06-2026
