(CRIME NO.20/2021) Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to modify the condition No.(b), that the petitioner shall make deposit of Rs.11,00,000/- (Rupees Eleven Lakhs Only) to the credit of the defacto complainant in the Crl.O.P.No.12742/2021 presence of the respondent police within a period of two weeks from the date of receipt of a copy of this order without prejudice to his defence before the trial Court and if the petitioner succeeds in the case, the said amount would be refunded back to him. The concerned Magistrate, shall accept the sureties furnished by the petitioner on such deposit being made and proof filed by the petitioner, imposed by this Hon`ble Court in Crl.O.P.No.12742 of 2021 by way of order dated 23.07.2021 and enabling the Petitioner to pay a sum of Rs.3,00,000/- to the defacto complainant in Crime No.20 of 2021 on the file of the Respondent police.

Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S K.PRADEEP RAJ, Advocate for the petitioner, and of MR.A.GOPINATH, Govt. Advocate ( Crl. Side) on behalf of the Respondent, the court made the following order:- This petition has been filed to modify the condition imposed by this Court vide order dated 23.07.2021 in Crl.O.P.No.12742 of 2021, wherein, the petitioner was directed to deposit a sum of Rs.11,00,000/- (Rupees Eleven Lakhs) to the credit of the defacto complainant in the Crl.O.P.No.12742 of 2021 presence of the https://hcservices.ecourts.gov.in/hcservices/

respondent police, without prejudice to his defence before the trial court and if the petitioner succeeds in the case, the said amount would be refunded back to him.

2. Learned Counsel appearing for the petitioner submits that this court while granting anticipatory bail to the petitioner on his own volition agreed to deposit the money.

Further the petitioner agreed to deposit the Rs.11,00,000/- (Eleven Lakh Rupees Only).

3. Hence, the modification petition is not pressed. Accordingly this modification petition is dismissed.
