Jayaraj ... Respondent On representation of the learned counsel on either side, this case is taken up for settlement before the Lok Adalat. The appellants and Mr.M.Gopi, learned counsel for the appellants and Mr.Jayaraj, respondent is present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows:

TERMS OF SETTLEMENT The appellants filed a suit for specific performance before the Additional Sub-Judge, Pondicherry in O.S.No.68 of 2008. The suit was dismissed. As against the dismissal, the appeal in A.S.No.5 of 2012 was filed by the appellants/plaintiffs before the II Additional District Judge, Pondicherry. The learned II Additional District Judge, Pondicherry, also confirmed the judgment and decree passed by the trial Court. Hence, the appellants/plaintiffs have come forward with this Second Appeal. 2.The appellants are present along with their counsel and the respondent is also present.

3.The appellants and the respondent compromised between themselves and thereby, the respondent agrees that he has received a sum of Rs.4,16,000/- (Rupees four lakhs and sixteen thousand only) and now, he is willing to execute the sale deed.

4.Therefore, this Second Appeal is disposed of in terms of the above settlement. No costs.

5.Registry is directed to expedite the return of case bundle to the trial Court and the appellants are directed to approach the trial Court by way of an application for return of original documents. 1.Venkatesan 2.Sundari Counsel for the Appellants Jayaraj This Lok Adalat award is passed in terms of the above settlement. The Court fee paid shall be refunded to the appellant in the manner provided under Section 69-A of the Tamil Nadu Court-Fees and Suits Valuation Act, 1955 and the Court Fees Act, 1870 as provided for under sub Sec.1 of Section 21 r/w 25 of LSA Act 1987 as amended in 1994.
