The petitioner and the respondent got married on 02.12.2016 at Erode. Due to matrimonial disputes, the parties are before the Court. Page No 1 of 4

2. The husband has moved a petition before the Sub Court at Omalur in H.M.O.P.No.121 of 2022 seeking divorce. Thereafter, the wife has moved a petition before the Judicial Magistrate Court at Dharmapuri in M.C.No.11 of 2022 seeking maintenance.

3. The petitioner/wife pleads that she is unable to travel from Dharmapuri to Omalur and hence, seeks transfer of proceedings in H.M.O.P.No.121 of 2022 to Dharmapuri.

4. The husband was served on 17.07.2023 but has not chosen to oppose this application.

5. Taking overall circumstances into consideration and giving priority to the interest of the wife, I am inclined to allow this transfer petition. Hence, the proceeding in H.M.O.P.No.121 of 2022 which is now pending on the file of the Sub Court at Omalur is withdrawn and it shall stand transferred to the file of the Sub Court at Dharmapuri District.

6. Accordingly, the Transfer Civil Miscellaneous Petition stands Page No 2 of 4

allowed. No costs. Consequently, connected Civil Miscellaneous Petition is closed.
