O R D E R

(The case has been heard through video conference) The petitioners, who apprehend arrest at the hands of the respondent police for the offences publishable under Sections 8 (c) r/w 20(b)(ii)(B) of NDPS Act & 328 of I.P.C in Cr. No.972 of 2020, on the file of the respondent police, seek anticipatory bail.

2. The case of the prosecution is that the petitioner was found in illegal possession of 1.5 kgs of Ganja and 5.659 gms of Mava. Hence, the complaint.

3. The learned counsel for the petitioners would submit that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. Therefore, he prays to grant anticipatory bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/

4. The learned Additional Public Prosecutor would submit that the petitioner was found in illegal possession of 1.5 kgs of Ganja and 5.659 gms of Mava. He further submitted that the petitioner has one previous case for the offence U/s 302 of I.P.C. Hence he opposed to grant bail to the petitioner.

5. Considering the above facts and circumstances of the case and the fact that there is one previous case pending against the petitioner, this Court is not inclined to grant bail to the petitioner.
