The petitioners, who apprehend arrest for the alleged offences under Sections 8(c) r/w 20(b) (ii) (B) & 29 (1) of NDPS Act 1985, Crime No.559 of 1/4

2025, on the file of the respondent police, seek anticipatory bail.

2. The case of the prosecution is that the petitioners and other accused were found in illegal possession of 2 kilograms of Ganja. The respondent, after following the mandatory provisions, seized the contraband. Hence the complaint.

3. The learned counsel appearing for the petitioners submitted that the entire contraband has been seized from A1 to A4, but the respondent police voluntarily roped the petitioners as they are having previous cases. Hence, he prays to grant anticipatory bail to the petitioners.

4. The learned Government Advocate (Crl.Side) would submit that there are totally 7 accused in this case, in which the petitioners are arrayed as A5 and A6. That apart, the 1st petitioner is involved in 7 previous cases and the 2nd petitioner is involved in 4 previous cases which are of similar nature. Hence, he strongly opposed to grant bail to the petitioners.

5. Considering the bad antecedents of the petitioners and that the custodial interrogation of the petitioners is very much required in this case, this Court is not inclined to anticipatory bail to the petitioners. 2/4
