The petitioner seeks anticipatory bail in Crime No.48 of 2023, registered by the respondent police for the offences punishable under Sections 419 & 420 of IPC.

2. The defacto complainant had stated that he received a call from his close relative that one of his friend, who was working in Dutch Bank at Chennai, had informed that since Reserve Bank of India had withdrawn Rs.2,000/- currency notes from circulation, those who had hidden Rs.2,000/- notes wanted to exchange them and if anybody brings Rs.500/- currency notes, they can get Rs.2000/- currency notes which would indicate doubling of the amount. The defacto complainant had presented a sum of Rs.15,00,000/- and at the time, two cars came and ten persons got down from the car in Police uniform and snatched away the cell phone and the said amount of Rs.15,00,000/-. Under those circumstances, the complaint had been lodged against the petitioner and other accused.

3. The learned counsel for the petitioner stated that some of the accused had been granted regular bail but the petitioner is still absconding.

4. It is stated that the petitioner is the first accused and option was given to the petitioner also to surrender but certainly, anticipatory bail cannot be granted unless he returns back the said amount of Rs.15,00,000/-.

5. In view of all these factors, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this criminal original petition stands dismissed.
