ORDER
This Criminal Miscellaneous Petition has been filed praying to enlarge the petitioner on bail by suspending the sentence imposed by the Sessions Judge, Additional Special Court for Exclusive Trial of Cases under POCSO Act, Villupuram in Spl.SC.No.92 of 2020 pending disposal of the aforementioned criminal appeal.
2. Heard the learned counsel appearing on either side and perused the materials available on record.
3. The case of the prosecution is that the petitioner kidnapped the victim girl and had sexual intercourse with her by force. After registration of FIR, the respondent filed final report on conducting investigation and the same was taken cognizance in Spl.SC.No.92 of 2020 on the file of the Additional Special Court for Exclusive Trial of Cases under POCSO Act, Villupuram. After full-fledged trial, the Trial Court convicted and sentenced the petitioner for the offence punishable under Sections 366 & 342 of IPC and Section 6 of POCSO Act. Aggrieved by same, the petitioner has preferred the aforementioned criminal appeal before this Court along with this application seeking to enlarge him on bail pending disposal of the aforementioned appeal.
4. On perusal of records, though the petitioner has prayed to enlarge him on bail, prima facie case is not made out to grant bail. Further, the petitioner committed very serious and heinous offence against the victim girl. Therefore, this Court is not inclined to entertain this petition. 5.
Accordingly, this criminal miscellaneous petition is dismissed.
