Mr.B.Jawahar, appearing on behalf of the petitioner, would submit that the proceeding in H.M.O.P.No.113 of 2022 was dismissed for default on 15.11.2023 and consequently, this transfer petition has become infructuous.

2. It is made clear that in case, the proceeding in H.M.O.P.No.113 of 2022 is restored back onto the file, liberty is granted to the petitioner to move a fresh application for transfer of proceeding before this Court.

3. Accordingly, the Transfer Civil Miscellaneous Petition stands dismissed as infructuous. Consequently, connected Civil Miscellaneous Petition is closed.
