Respondents Writ Petition is filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Certiorarified Mandamus, calling for the records in Na.Ka.No.04/5919/11 dated 22.07.2011 on the file of the first respondent and quash the same and direct the first respondent to include the petitioner's name in the beneficiary list of T-Sunami affected victims for providing free constructed house at Semmancheri, Chennai. O R D E R

The order dated 22.07.2011 passed by the first respondent, rejecting the claim of the petitioner for grant of T-Sunami house by the Tamil Nadu Slum Clearance Board, is under challenge in the present writ petition.

2. The petitioner states that their house was badly affected due to T-Sunami waves on 26.12.2004. The Government of Tamil Nadu under T-Sunami Rehabilitation Programme granted relief to those who all are affected by T-Sunami by way of providing free house at Semmancheri, Chennai, through Tamil Nadu Slum Clearance Board.

3. The husband of the petitioner also applied for the relief on 23.06.2011. Subsequently, the petitioner also submitted an application on 23.06.2013. However, the first respondent rejected the claim of the petitioner in proceedings dated 22.07.2011 by stating that the name of the petitioner was not found place in the list of eligible persons for grant of TSunami House for Sunami relief.

It is further contended that the petitioner's family had been residing in Government Official Quarters during the time of T-Sunami and therefore, they are not eligible for allotment of free house in T-Sunami affected victims. Thus, the name of the petitioner was not found place in the beneficiary list finalised by the Tahsildar.

This being the factum, established, the petitioner was not found eligible to get the T-Sunmai relief and therefore, the name of the petitioner was not included in the beneficiary list of eligible persons.

Consequently the writ petition is devoid of merits and it stands dismissed. However, there shall be no order as to costs.
