O R D E R

The suit for partition filed by one Pushpalatha against her siblings in O.S.No.1 of 2014 on the file of the Additional District Judge, Fast Track Court, Villupuram and the same was decreed in favour of the plaintiff, holding that she Page Nos.3/7

is entitled for 1/5th share in item Nos.2 & 3 in the suit schedule property and 1/4th share in item Nos.6 & 7 of the suit schedule property.

2. Being aggrieved, the defendants 9 & 10 had preferred Appeal Suit before this Court and the same is numbered as A.S.No.57 of 2023.

3. The Learned Counsel appearing for either side agreed for referring the matter to the Mediation Centre, High Court, Madras. Accordingly, the matter was referred for mediation.

4. In the mediation, the parties have settled their dispute and entered into a settlement agreement dated 05.01.2026.

5. The appellants and 1st respondent who is the plaintiff have signed the settlement agreement, wherein the successful plaintiff had given up her right in item Nos.2 & 3 of the suit schedule property in favour of the 2nd appellant, on receipt of Rs.10,00,000/- (Rupees Ten Lakhs only) towards her 1/5th share in the item Nos.2 & 3. In respect of item Nos.6 & 7, the appellants recorded no objection to pass final decree in terms of the preliminary decree passed by the Additional District Judge, (Fast Track Court), Villupuram in O.S.No.1 of 2014. 6. As a result, the parties are agreed to get compromise decree in terms of the settlement. The Learned Counsel appearing for the appellants submitted that the decree may be passed in terms of the settlement.

7. In view of the settlement arrived between the parties, A.S.No.57 of 2023 is disposed of in terms of the settlement. The terms of agreement shall form part of the decree. There shall be no order as to costs. Consequently, connected Miscellaneous Petition is closed.
