Petition filed under Article 226 of the Constitution of India for the issuance of writ of mandamus, directing the respondent herein to pay subsistence allowance to the petitioner during the period of his suspension at the rate provided under the Model Standing Order or Minimum wage whichever is higher from the date of petitioner's suspension till completion of Enquiry and direct the respondent to complete the enquiry against the petitioner. O R D E R

The petitioner was suspended from service, pending initiation of disciplinary proceedings by order dated 10.01.2015. Since he was not paid subsistence allowance in accordance with Regulations, the petitioner is before this Court.

2. The learned Standing Counsel for Tamilnadu State Marketing Corporation Limited on instructions submitted that disciplinary proceedings would be completed within a period of three months. The learned Standing Counsel would further submit that subsistence allowance would be paid to the petitioner in accordance with Regulations.

3. The respondent is directed to conclude the disciplinary proceedings initiated against the petitioner as expeditiously as https://hcservices.ecourts.gov.in/hcservices/

possible and in any case within a period of three months from the date of receipt of a copy of this order. It is needless to point out that the petitioner should be paid subsistence allowance during the currency of disciplinary proceedings. The arrears of subsistence allowance as on date shall be paid within a period of two weeks from the date of receipt of a copy of this order.

4. The writ petition is disposed of with the above direction. No costs.
