O R D E R

The petitioner, who was arrested and remanded to judicial custody on 10.04.2025, for the alleged offence punishable under Sections 316(2), 318(4), 351(2) of BNS Act, in Crime No.156 of 2025, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the defacto complainant got into acquaintance with A1 who came to the house of the defacto complainant to conduct tuition for her children. During the course of her acquaintance, A1 induced the defacto complainant to invest in gold business, believing her word, defacto complainant invested a sum of Rs.41 lakhs and 80 sovereign gold jewels, and thereafter the accused persons neither paid the high returns nor returned the money & jewels. Hence, the complaint.

3. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and she has been falsely implicated in this case. He would further submit that the petitioner was arrested and is in judicial custody from 10.04.2025 and ready to abide by any conditions that 2/4

may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

4. Learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the total money involved in this case is to tune of 2.50 Crores and the investigation is at nascent stage. Hence, he opposed for grant of bail to the petitioner.

5. Considering the gravity of the offence committed by the petitioner, the amount involved and the fact that the investigation is at preliminary stage, this Court is not inclined to grant bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed. 21.05.2025 Sma 3/4
