Writ Petition is filed under Article 226 of the Constitution of India, praying to issue a writ of mandamus, directing the respondents 1 to 5 to protect the interest of the petitioner in respect of properties bearing T.S.Nos.2481 and 2482 in Vasantharayanpalayam, Cuddalore, Cuddalore Municipal limits, Cuddalore Taluk and District, under the provisions of the Scheduled Caste and Scheduled Tribes [Prevention of Atrocities] Act, 1989.

O R D E R

Heard the learned counsels appearing on behalf of the petitioner, as well as respondents 1 to 5. There is no representation on behalf of respondents 6 and 7.

At this stage of the hearing of the Writ Petition, the learned counsel appearing on behalf of the petitioner had submitted that it would suffice, if this Court passes an order directing the 5th respondent to enquire and pass orders on the representation made by the petitioner, dated 23.11.2011, within a time frame.

3. The learned counsel appearing on behalf of respondents 1 to 5 has no objection for such an order being passed by this Court.

4. In view of the submissions made by the learned counsels appearing on behalf of the parties concerned, the petitioner is directed to give a fresh representation to the 5th respondent, within a period of two weeks from the date of receipt of a copy of this order. On receipt of such representation, the 5th respondent is directed to enquire into the matter and pass appropriate orders thereon, within a period of eight weeks thereafter, after giving an opportunity of hearing to the petitioner, as well as respondents 6 and 7, and the other persons concerned, if any. However, it is made clear that this Court, by this order, has not expressed any opinion on the merits of the matter.

5. Accordingly, the Writ Petition is disposed of, with the above directions. No costs.
