Prayer : Writ Petition filed under Article 226 of Constitution of India praying for the issuance of a Writ of Certiorarified Mandamus, to call for the records on the file of the fifth respondent in proceedings C.A.No. 008896 dated 05.11.2020 and to quash the same as illegal, incompetent and without jurisdiction and to further direct the respondents to take delivery of the goods which are lying with the petitioner in a deliverable state and further direct the respondents to pay the undisputed sum of Rs.45,28,087/- with interest @ 18% p.a., till the date of payment to the petitioner.

ORDER

This Writ Petition has been filed for the issuance of Writ of Certiorarified Mandamus, to call for the records on the file of the fifth respondent in proceedings C.A.No. 008896 dated 05.11.2020 and to quash the same as illegal, incompetent and without jurisdiction and to further direct the respondents to take delivery of the goods which are lying with the petitioner in a deliverable state and further direct the respondents to pay the undisputed sum of Rs.45,28,087/- with interest @ 18% p.a., till the date of payment to the petitioner.

2. Heard the learned counsel on either side and perused the materials available on record.

3. The learned counsel for the petitioner would submit that the order impugned in this writ petition has been withdrawn.

4. Recording the above said submission, this writ petition is Closed. Consequently, connected Miscellaneous petitions are closed. There shall be no order as to costs.
