Crl.O.P.No.14783 of 2024 T.V.THAMILSELVI, J.

The petitioner, who was arrested and remanded to judicial custody on 08.05.2024 in Crime No.110 of 2024, for the offence punishable under Section 294(b), 324, 307, 448, 506(ii) of IPC and Section 4 of TNPWH Act, seeks bail.

2. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case, as if he was in illegal intimacy with the defacto complainant's wife. He further submitted that the petitioner is suffering incarceration from 08.05.2024 and he is ready to abide any stringent conditions that may be imposed by this Court. Hence, he prays for grant of bail to the petitioner.

3. Learned Government Advocate (Crl.Side) appearing for the respondent police raised objection for granting bail to the petitioner stating that due to previous enmity between the petitioner and the defacto complainant, for which, the petitioner attacked the defacto complainant with sickle and attempted to commit murder and also intimidated with dire consequences, thereby the defacto complainant was seriously injured T.V.THAMILSELVI, J.

drl and also five persons got injured in the alleged offence. He further submitted that it is a case and case in counter. He further submitted that the petitioner has four previous cases pending against him. He further submitted that the investigation is still pending. Hence, he prayed for dismissal of the bail petition.

Taking into consideration the facts and circumstances of the case and the submission made by the learned counsel on either side and the nature and gravity of the offence and also considering the fact that the nature of injury sustained by the injured, this Court is not inclined to grant bail to the petitioner.

6. Accordingly, this Criminal Original Petition stands dismissed.
