Seeking to condone the delay of 435 days in representing the Second Appeal against the decree and judgment of the learned III Additional District and Sessions Judge, Vridhachalam, Cuddalore District made in A.S.No.88 of 2011 dated 05.03.2014, the petitioners have come up before this Court with this petition. 2.

I have heard the learned Counsel for the petitioners and I have also perused the records carefully.

I am also satisfied with the reasons stated in the affidavit filed in support of the petition. Further, I am of the view that on a technical ground of delay, the valuable right of contest of the parties cannot be deprived of. 4.

Having regard to all the above, the delay is condoned and the petition is allowed.
