O R D E R

This Review Application is filed to review the order dated 01.02.2010 passed by this Court in C.R.P.(PD).No.3464 of 2009.

2. When the matter was taken up for hearing, Mr.Mukunth, M/s.Sarbhauman Associates, learned counsel appearing for the petitioner submitted that this Court, in CRP (NPD) No.2506 of 2007, by order dated 09.09.2008, directed the petitioner to file appeal, if

he is aggrieved with the final decree passed by the Trial Court and contended that the Civil Revision Petition was not disposed of on merits and hence there is an error apparent, in the order passed by the learned Judge.

3. The Review Application is of the year 2008. However, till date, no notice was ordered. From the order of this Court dated 09.09.2008, it is seen that the Civil Revision Petition was dismissed after hearing the learned counsel for the petitioner as well as respondent, on merits and after considering the entire facts of the case. In the above circumstances, there is no error apparent in the order passed by the learned Judge.

4. In the result, this Review Application is dismissed. No costs. Consequently, connected Miscellaneous Petition is closed. The learned Judge is directed to dispose of the suit in O.S.No.1093 of 1990, as expeditiously as possible, not later than three months from the date of receipt of copy of this order, if not already disposed.
