Therefore, he states that the present Transfer Civil Miscellaneous Petition has become infructuous. Hence, he seeks permission of this Court to withdraw this Transfer Civil Page No 1 of 3

Miscellaneous Petition.

2. Permission is granted. In case, the ex parte decree is set aside, liberty is granted to the petitioner to approach the Court again. Accordingly, the Transfer Civil Miscellaneous Petition stands dismissed as infructuous. No costs.
