The petitioner, who was arrested and remanded to judicial custody on 21.05.2024 in Crime No.231 of 2024, for the offences punishable under Sections 406, 420, 120(B) of IPC on the file of the respondent police, seeks bail.
2. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case . He would submit that he is in jail from 21.05.2024. Hence, he prayed to grant bail to the petitioner.
3. The learned Government Advocate (Crl. Side) submitted that, defacto complainant was working as a Deputy General Manager in Tata Motors, which is under VST Motor Company. The Tata Motors Company have elected 102 employees who have successfully sold large number of Tata Vehicles in the year 2023-2024 for a fun trip to Thailand and finalized 93 eligible employees and approached the petitioner, who is running a Arha Travels for quotation. Petitioner requested the defacto complainant to transfer the amount in the account of A1 Company, as the petitioner did not have GST. Accordingly, the amount was transferred and thereafter, the petitioner assured that he had received the entire amount. Petitioner along with A1 received a sum
of rs.28,99,740/- from the defacto complainant for arranging tickets, but failed to do so. On demand, petitioner has repaid a sum of Rs.9,70,200/- on various dates and failed to repay the balance amount of Rs.19,29,540/-. When the defacto complainant demanded to repay the said amount, accused threatened the defacto complainant with dire consequence. He further submitted that the amount is not yet recovered and A1 is still absconding.
4. Considering the gravity of the offence committed by the petitioner and that the cheated amount of Rs.19,29,540/- is not yet recovered and A1 is still absconding, this Court is not inclined to grant bail to the petitioner.
