PRAYER: Writ Petition filed under Article 226 of the Constitution of India, seeking issuance of mandamus, directing the respondents to restore the possession of the property at Block No.2, Survey No.23/1, Survey No.1/1, Chinnakudal, No.664/639/8, Periyarsalai, Anna Nagar, Chennai - 29 to an extent of 880 Sq.ft. and forbear the respondents from disturbing the petitioner's peaceful possession and enjoyment of the property without due process of law. ORDER
This writ petition is filed for a direction to the respondents to restore the possession of the property at Block No.2, Survey No.23/1, Survey No.1/1, Chinnakudal, No.664/639/8, Periyarsalai, Anna Nagar, Chennai - 29 to an extent of 880 Sq.ft. and forbear the respondents from disturbing the petitioner's peaceful possession and enjoyment of the property.
2. The learned counsel appearing for the petitioner would submit that the 2/5
petitioner is in occupation of the Grama Natham land, in which, he had constructed building. However, without notice, all of sudden, the building has been demolished by the respondents. Hence, the petitioner filed this writ petition for payment of compensation.
3. This Court posted a question whether the petitioner has possessed a patta for the Grama Natham land however, the petitioner does not reveal that the patta is possessed by him. Since the petitioner has not established the title, such a dispute cannot be adjudicated before the Court under Article 226.
4. In view of the same, this Writ Petition is dismissed with liberty to the petitioner to approach the competent civil Court and the Civil Court is directed to pass orders without influencing any of the observations made in this writ petition. No costs.
