This Criminal Original Petition has been filed by the petitioner/A3, who was arrested and remanded to judicial custody on 25.04.2024, seeking bail in Crime No.119 of 2024, registered under Section 304 of IPC @ for the offences under Sections 8(c) r/w 21(a), 29(1) of Narcotic Drugs and Psychotropic Substances Act, 1985.
2. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case only based on the confession recorded from the other accused. He further submitted that the petitioner has nothing to do with the alleged offence and he has been suffering incarceration from 25.04.2024 and he is also ready to abide by any stringent conditions that may be imposed by this Court. Hence, he sought for bail.
3. Learned Government Advocate (Crl.Side) appearing for the respondent police submitted that, the de facto complainant's son, who was addicted to intoxication, injected himself the glucose mixed with banned tablets, for intoxication, due to which, he died. He further submitted that the petitioner/A3 along with two other accused were indulged in selling the banned tablets for intoxication and they have sold the tablets to the victim/deceased. The respondent had seized the nitravet, tydol and tapendol tablets from the petitioner and also from other accused, who were detained under Act 14. He also submitted that two previous cases registered for NDPS Act are pending against the petitioner and the investigation is also pending. 4. The respondent has filed a counter before this Court.
5. Taking into consideration the facts and circumstances of the case, submissions made by the learned Government Advocate (Crl.Side) that the investigation is still pending and also considering the gravity of the offence committed by the accused, this Court is not inclined to grant bail to the petitioner.
