Advocate ( Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who apprehends arrest for the alleged offence punishable under Sections 8(c) and 20(b) (ii) (B) of NDPS Act, in Crime No. 679 of 2021 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner was found to be in a possession of 1 kilo and 100 grams of ganja. Hence, the complaint.

3.The learned counsel appearing for the petitioner submits that he has not committed any such offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) submits that the the petitioner was found to be in a possession of 1 kilo and 100 grams of ganja. He further submits that the petitioner is a habitual offender and he is having two previous cases similar in nature and an history sheet H.S.No.404 of 2021 similar in nature. 5.Considering the facts and circumstances of the case and also the fact that the offence committed by the petitioner is serious one and considering the gravity of offence, this Court is not inclined to grant anticipatory bail to the petitioner.
