This Criminal Original Petition has been filed by the petitioner, who was arrested and remanded to judicial custody on 09.04.2024, seeking bail in Crime No.289 of 2024 registered under 174 Cr.P.C and later altered for the offences punishable under Sections 302, 201, 202 r/w 120B of IPC.
2. Learned counsel appearing for the petitioner submitted that this is the second application for bail filed by the petitioner before this court and this Court had dismissed the earlier bail application vide order dated 07.06.2024 in Crl.O.P.No.13244 of 2024. He further submitted that the petitioner has nothing to do with the alleged offence and the petitioner is suffering incarceration from 09.04.2024. Hence, he prayed for grant of bail to the petitioner.
3. Learned Government Advocate (Criminal Side) appearing for the respondent police submitted that the first accused murdered one Karthick during the quarrel that arose between them while they were drinking liquor together and thereafter, he had taken the photograph of the dead body and sent the same to accused 2 and 3 and then, the accused conspired together and screened the offence. He further submitted that initially the case was registered under Section 174 Cr.P.C. and later altered under Sections 302, 201, 202 r/w 120B of IPC. He also submitted that the earlier bail application filed by the petitioner was dismissed on 07.06.2024 and there is no change in circumstances. 4. Taking into consideration the facts and circumstances of this case and the submissions made by the learned Government Advocate (Criminal Side) that there is no change in circumstances and the investigation is not yet completed, this Court is not inclined to grant bail to the petitioner.
