This writ petition has been filed for issuance of a writ of mandamus to direct the first respondent to issue appropriate directions to the 4th respondent to declare the petitioner's probation with effect from 10.01.2015 and grant all monetary and service benefits within a time frame to be fixed by this Court by considering the representation dated 04.03.2025.
2. I have heard Ms.S.Varsha, learned counsel for the petitioner and
Mrs.R.Anitha, learned Special Government Pleader for the respondents.
3. The petitioner was appointed on 11.01.2013. Though she had been working in the Government service for a decade and more, her probation was not confirmed. Taking into consideration the unfortunate circumstances in which the petitioner is working, I called upon the learned Government Advocate to get instructions as to why the unfortunate situation exists and had been permitted to continue, I posted the matter today.
4. When I took the matter for hearing today, Mrs. R.Anitha, learned Special Government Pleader has produced instructions from the Additional Chief Secretary to Government vide letter No.1278/Ser-7(1)/2013, dated 20.05.2025. The instruction states that the individual had been sent for survey training and on account of that fact no training was given for the year 20162017 and since it was cleared on 29.01.2018, there has occasioned a delay. The instruction further reveals that after obtaining approval from the Human Resources Management Department, appropriate orders confirming the probation will be passed within four weeks.
5. Taking the letter issued by the Additional Chief Secretary to Government to the learned Government Advocate as an undertaking given to this Court, the writ petition is disposed of. There shall be a direction to pass an order of probation within a period of four weeks from today.
