SHANMUGAM [ PETITIONER IN BOTH THE PETITIONS ] Vs 1 THE DISTRICT COLLECTOR [ RESPONDENTS IN BOTH THE PETITIONS ] NAMAKKAL DISTRICT, NAMAKKAL 2 THE SPECIAL DISTRICT REVENUE OFFICER, (LAND ACQUISITION OFFICER) TAMIL NADU ROAD SECTOR PROJECT II, DIVISIONAL OFFICE- HIGHWAYS, SALEM 636 005 3 THE DIVISIONAL ENGINEER TAMIL NADU ROAD SECTOR PROJECT II, DIVISIONAL OFFICE - HIGH WAYS, SALEM 636 005 Petitions praying that in the circumstances stated therein and in the respective affidavits filed therewith the High Court will be pleased to (i)To issue direction to the Respondents to pay the value for 19 coconut trees which were cut and removed besides granting compensation of Rs.10 lakhs for the paid and sufferings and for depriving the Petitioner right to life and property in the Petitioner and in R.S.No.
248/2 and order for recovery of the same from the authorities who are responsible for the said misdeeds committed in violation of the order dated 30.01.2018 in WP No.1709/2018 (in WMP.
(ii)To take action against the Respondents, their subordinates and police authorities who were responsible for the mischief committed in the Petitioners lands in R.S.No.248/2, Chittalandur Village Tiruchengode Taluk, Namakkal District by taking the law in their own hands on 30.01.2018, in violation off the order dated 30.01.2018 in WP No.1709 of 2018. (in WMP.2820/2018)
Order : These petitions coming on for orders upon perusing the petitions and the respective affidavits filed in support thereof and upon hearing the arguments of M/S.N.MANOKARAN, Advocate for the petitioner in both the petition and of MR.M.KARTHIKEYAN, Additional Government Pleader on behalf of the 1 TO 3 Respondents in both the petitions the court made the following order:- Mr.N.Manoharan, the learned counsel for the petitioner submitted that the Land Acquisition authorities have agreed in principle and pay the compensation for the trees cut. Mr.M.Karthikeyan, the learned Additional Government Pleader appearing for the respondents is also confirmed it. In view of this development, this Court finds that nothing survives in these Writ Miscellaneous Petition and therefore the same are closed. 2.
The Land Acquisition Authority may act in strict adherence to law in computing the value of the trees before making payment.
