ORDER

(Order of the Court was made by G.R.SWAMINATHAN J.) The present Writ Petition is filed to direct the respondents to give immediate, proper and adequate medical treatment to the petitioner's husband, namely Murugan S/o.Ponnusamy, PID No.102160 aged about 56 years, now confined in Central Prison-II, Puzhal, and to take Disciplinary action against the 4 th respondent.

2. Heard the learned counsel appearing for both sides.

3. The petitioner's husband is an under trial prisoner in Central Prison - II, Puzhal. The petitioner alleges that her husband was brutally attacked by the 4 th respondent. The petitioner has filed this Writ Petition seeking a two fold relief, viz., (a) to provide an appropriate medical treatment for her husband and (b) to take disciplinary action against the 4 th respondent.

4. The third respondent filed a counter affidavit and it is stated that based on the medical opinion, the petitioner's husband is suffering from Chronic periodontitis, which is the cause for the broken teeth.

5. Be that as it may, we direct the third respondent to continue to provide the proper and adequate medical treatment for the petitioner's husband viz., Murugan, aged about 56 years, S/o.Ponnusamy, now confined in Central Prison -II, Puzhal, Chennai, based on the medical condition and need.

6. The petitioner has given a representation to the 3 rd respondent to take disciplinary action against the 4 th respondent. This Court, based on the available materials, cannot issue any positive direction. It is seen that the petitioner had already given a representation to the second respondent. Hence, the 2 nd respondent is directed to look into the same and take appropriate action on the representation given by the petitioner.

7. With the above directions, this Writ Petition stands disposed of. There shall be no order as to costs.
