PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the respondents to disburse the payments relating to difference of gratuity, EL surrender and pension arrears as per 14th Wage Settlement and other unpaid benefits and considering the petitioner representation dated 25.02.2025 within the stipulated time as may be fixed by this Court and pass orders.

ORDER
The writ petition has been filed seeking a mandamus to direct the respondent to pay the difference of gratuity, EL surrender and pension arrears as per 14th Wage Settlement and other unpaid benefits by considering the petitioner's representation dated 25.02.2025.
2. It is the case of the petitioner that he had joined as Conductor in the respondent-Corporation on 09.05.1987, and was superannuated on 31.05.2022. The petitioner would submit that 14th Wage Settlement was entered into between the petitioner Transport Corporation and Employees of the Corporation on 24.08.2022. As per the settlement, the persons who were in service from 01.09.2019 to 31.07.2022 would receive the revised monetary benefits in terms of 14th Wage Settlement. The petitioner had retired on 31.05.2022. However, 14th Wage Settlement was signed later on 24.08.2022, and it cannot deprive the petitioner for getting the benefit.
3. In view of the above, the respondents are directed to examine the 2/4
request of the petitioner and extend the benefit of the 14th Wage Settlement to the petitioner, if otherwise eligible, within a period of three weeks from the date of receipt of copy of this order.
